About Ontario's Statutory Accident Benefits

Statutory Accident Benefits are included in all auto insurance policies in Ontario. Coverages for Medical, Rehabilitation and Attendant Care benefits are mandatory.

However, the Ontario Government has declared that some benefits that used to be mandatory (like Income Replacement, Non-Earner, and Caregiver benefits) are now optional as of July 1, 2026.

While opting out of coverages that used to be mandatory might reduce your insurance premium, be careful this doesn’t accidentally create critical gaps in your coverage. Accidents can get expensive if you don’t have all the coverage you need.

Your Mandatory Statutory Accident Benefits

This coverage comes standard on all auto insurance policies in Ontario. It helps compensate for medical expenses, and other types of support if you're ever injured in an auto accident.

  • Medical and Rehabilitation benefits

    Helps pay for expenses related to medication, rehabilitation, physiotherapy, etc.

  • Attendant Care benefit

    Helps you pay for services provided by an aide or attendant or by a long-term care facility, if needed after an auto accident.

  • Cost of Examinations benefit

    Covers the cost of any examinations and assessments you may need to have before accessing benefits you’re entitled to.

Add any of these optional coverages

Adding any of these coverages to your Standard Accident Benefits gives you greater support if you or someone on your policy is injured in an auto accident and needs time to recover.

Who's covered These benefits apply to you, your spouse, any dependants that either of you have, and any drivers you add to the policy.

  • Income Replacement

    If you are unable to work, this can cover 70% of your gross income, up to $400 per week. You can increase this to up to $1,000 per week.

  • Non-Earner

    If you don’t qualify for income replacement, and can't continue daily life as before the incident, you may qualify for $185 per week.

  • Caregiver

    If you can't care for someone who needs it, you could receive compensation to hire someone to help you care for them.

  • Dependant Care

    Helps pay for qualifying expenses incurred caring for your dependants after you've been injured in an auto accident.

  • Lost Educational Expenses

    Compensation for lost tuition, books and other education-related expenses up to $15,000.

  • Expenses of Visitors

    Covers reasonable expenses incurred by family and friends who visit you during recovery and treatments.

  • Damage to Personal Items

    Receive compensation for damaged clothing, glasses and other personal belongings damaged during the accident.

  • Indexation

    Annual adjustment for inflation for many benefits according to the Consumer Price Index for Canada.

  • Death and Funeral

    Helps maintain financial stability if someone on your policy passes away from their auto accident injuries.

  • Housekeeping and Home Maintenance

    Receive up to $100 per week for any extra reasonable expenses to help with housekeeping and maintaining your home while you recover. This benefit applies to all impairments, but you may opt to only access this benefit if you’re “catastrophically impaired.”

Frequently Asked Questions

If you’re an existing customer, your current coverages—including any benefits that are optional as of July 1, 2026—will continue unless you choose to remove them. You can review your insurance and decide whether you would like to remove certain coverages during your next renewal cycle, or on or after July 1, 2026. Medical, Rehabilitation and Attendant Care benefits, as well as coverage for Cost of Examination benefits will still be included in all standard auto insurance policies in Ontario. If you already have your personal auto insurance with us, you can log in to MyInsurance or your TD Insurance app to review your existing coverage. Your optional benefits will continue, but after July 1, 2026, you will have an opportunity to opt out of any benefits you don’t need or add new ones that you do and adjust your coverage limits as needed. The change is being made by the Ontario Government to make auto insurance more flexible and customer focused.


The changes will apply to both personal and commercial auto insurance customers who live in Ontario. These changes also apply to motorcycles, ATVs, snowmobiles and motorhomes. If you're interested in opting out of coverages that used to be mandatory, please be careful this doesn’t accidentally create critical gaps in your coverage and create larger expenses for you in the event of an auto accident.


You might be considering removing coverages to lower your insurance costs now that many Accident Benefit coverages are optional. However, we strongly recommend that you carefully consider the risks and added financial exposure of forgoing specific coverages before making any changes to your existing policy. These coverages are designed to give financial support and provide access to a variety of services that could greatly accelerate the recovery of the injured person or persons. While removing coverages could result in short-term savings, the potential implications of not having adequate coverage in the event of an injury or death could be severe.


Your policy will be updated to reflect these changes as of your first renewal after July 1, 2026. Your current coverage, including now-optional benefits that you may have previously purchased, will automatically continue unless you choose to remove them. You can review your insurance and decide whether you would like to remove or update certain coverages during your next renewal cycle, or on or after July 1, 2026.
